The Department of the Army Criminal Investigation Division provides a formal process for authorized individuals to request the amendment, correction, or expungement of their Army CID criminal records from Department of Defense law enforcement reports, the Defense Central Index of Investigations, and the FBI National Crime Information Center database.

Mandated by the National Defense Authorization Act for Fiscal Year 2021, this policy allows for the removal of records if it is determined that probable cause did not exist for the alleged offenses.

Expungement / Amendment Requests

If you are eligible to have your Army CID criminal record amended, corrected or expunged you must fill out this form ► Privacy Act Request to Change Records and either digitally or physically sign it. You must also provide a copy of a valid U.S. government or state issued identification e.g. military ID, driver’s license, social security card.

Requests will not be processed unless filled out completely and submitted with all the required documentation.

Qualifying requests will be reviewed in accordance with ► Section 545 of Public Law 116-283 and ► DoD Instruction 5505.7.

Appeal of Denied Expungement / Amendment Requests

If your request to amend, correct, or expunge your records is denied you have the right to appeal.

To submit an appeal fill out this form ► Privacy Act Appeal of Denied Amendment and either digitally or physically sign it. You must also provide a copy of a valid U.S. government or state issued identification e.g. military ID, driver’s license, social security card. .

Requests will not be processed unless filled out completely and submitted with all the required documentation.

Federal Bureau of Investigation (FBI) National Crime Information Center (NCIC) Correction Requests

If you are only seeking to have your NCIC record corrected or updated in the FBI Database, obtain a copy of your NCIC printout by following the instructions found here ► FBI Identity History Summary Check (Rap Sheets).

Once you have obtained a copy of the NCIC printout, complete this form ► Request to Change Record Concerning NCIC Only and either digitally or physically sign it. You must also provide a copy of a valid U.S. government or state issued identification e.g. military ID, driver’s license, social security card.

Requests will not be processed unless filled out completely and submitted with all the required documentation.
Qualifying requests will be reviewed in accordance with ► Section 545 of Public Law 116-283 and ► DoD Instruction 5505.7.
